Allodial Title Research Subcommittee

Purpose

The Allodial Title Research Subcommittee is established under the Land and Public Assets Working Group to research the historical origins, meaning, development and practical application of allodial title and related forms of land tenure.

Its purpose is to build a clear, well-sourced understanding of the subject so the wider Working Group can assess whether any principles associated with allodial title may be relevant to the future Terra Australis land and property framework.

Scope of work

The Subcommittee will research historical texts, land tenure systems, patents and grants, ownership and stewardship models, inheritance and transfer arrangements, taxation and encumbrances, and the distinction between allodial title and other forms of landholding.

Where modern claims or interpretations are considered, the Subcommittee will distinguish clearly between historical evidence, current practice, opinion and unverified claims.

Outcome

The Subcommittee will provide the Land and Public Assets Working Group with a concise research report setting out:

  • what allodial title historically meant and how it has been used;
  • the principles and characteristics associated with it;
  • areas of agreement, uncertainty or conflicting interpretation;
  • possible benefits, limitations and practical considerations;
  • questions requiring further research; and
  • any recommendations for consideration within the developing Terra Australis land framework.

The Subcommittee is a research body only. It does not determine land ownership policy or confer any title, status or rights. Its findings are provided to the Land and Public Assets Working Group for wider consideration and development.
